This 3-hour class will provide a basic understanding in the practical application of Contract, Warranty, and Tort Law concepts in the insurance claims process. The area of Contract Law will include discussion of the use of Hold-Harmless Agreements and Vendors Endorsements. Breaches of the Express and Implied Warranties of Fitness and Merchantability will be addressed in the area of Warranty Law. Negligence theories against manufacturers, distributors, and sellers in the design, production, or assembly, and distribution of products will be covered in the Tort Law section. An understanding of the important legal concepts of Res Ipsa Loquiter against the manufacturer and Strict Liability in Tort against the distributor or seller will be covered as well as possible legal defenses for potential defendants.
